I think the main difference with the American system is that the congress can impeach a president and the senate can then censor or punish that president during their term if they so choose (Trump was impeached 2x by congress but the republican majority senate refused to lay penalties). In this way there’s almost a separate legal system reserved for the executive branch that keeps them accountable to the people by means of their elected representatives. I understand this decision in this case since it means that the president can be prosecuted while in office if he contradicts the will of the people, but he is seen to have acted in an official capacity otherwise and can’t be targeted after his term is over. Very multi-layered, but you can argue it makes a lot of sense from a constitutional republic point of view. If we were to imagine this system in a parliamentary democracy like in Canada, then it falls on its face because we don’t have the same style of biannual representative election like they do and we can’t hold the prime minister accountable to the people in the same way.
