The Manitoba Royal Canadian Mounted Police (RCMP) and a Crown prosecutor announced on Wednesday that no charges will be authorized in connection with a tragic bus crash that claimed the lives of 17 people near Carberry, west of Winnipeg.
"We hope to provide the 'why' of what happened … but in this case, we cannot say why the bus proceeded into the intersection that day when it was unsafe to do so," RCMP Supt. Rob Lawson said.
"The semi-truck had dashcam video. The video was consistent with the description provided by the driver. He attempted to avoid the collision, but the bus driver did not appear to see the semi-truck coming," Crown attorney Chris Vanderhooft said.
The RCMP collision analyst confirmed the information that there were blind spots and that the bus had only been in operation with Quality Care Transit for about a month prior to the collision. There were no mechanical defects with the bus," Vanderhooft added.
The investigation included obtaining search warrants for the phone of the bus driver, ultimately determining that the phone was not in use at the time of the collision. The bus driver, who suffered a traumatic brain injury, has no recollection of the incident and therefore cannot be interviewed.
"While the Crown is certainly aware of the consequences of this mass casualty and the tragedy that the families have had and continue to deal with, there is no public interest in proceeding against the bus driver, and we have therefore decided not to authorize criminal charges," Vanderhooft added.
The crash, which occurred last June near Carberry, west of Winnipeg, involved a bus carrying seniors to a casino and a semi-trailer on the Trans-Canada Highway.

So blaming blind spots in a vehicle is now a valid defense in Canada against criminal negligence.

EVERY bus has blind spots. Every driver is trained to “Rock and Roll” to safeley overcome that challenge. If you don’t Rock and Roll, you’re driving carelessly.

@@glennporter2590 Indeed. It was interesting when the CP said that they don't look at the consequences of their decision when making their decision. Clearly they did that (even though denied it directly when asked) as the driver will be incapacitated for life and a trial in this case is probably pointless to the driver's outcome as he'll be in his own prison the rest of his life. BUT, the CP and RCs spoke out of both sides of their mouths. This is the sign of weak people and a weak country that is incapable of handing the truth.

There has to be someone who saw the bus company prior to the crash. It should be made public.

2018 Humboldt bus crash, the truck driver went to jail because he was brown. In this 2023 bus there are no charges because everyone involved was white.🤡🤡🤡🤡🤡

Mr Vanderhooft knows well that everyone who goes before a court swears to tell the truth, the WHOLE truth and NOTHING BUT the truth. Does the same apply to going before the public? He tells that truth when he says that the bar for obtaining a CRIMINAL CODE charge is beyond what the investigation/ evidence can provide, but what about the Highway Traffic Act charge of Careless Driving? An inculpatory statement from the driver isn’t always available, nor is it required. Advertant or Inadvertant, the responsibility of care and attention remains, and that is well established by case law isn’t it? The Crown tells the truth in every sentence, measured and concise as lawyers are required. Shame on you Mr Vanderhhooft.

Few like to hear the truth. The driver caused the accident, not a blind spot. To hear the Crown Prosecutor lie like he did, am I surprised? No.
